H-1B visa which allows the immigrants to temporarily work and stay in the US is a highly debated visa. Many […]

H-1B visa which allows the immigrants to temporarily work and stay in the US is a highly debated visa. Many immigrants aspire for this visa to immigrate to the US. In recent years, this program has come under threat from the Donald Trump Administration.

Does the H-1B Visa Affect the Native Workers?

A major issue concerning this visa is that giving out H-1B visas to immigrants hurts the employment levels of native workers. But, many studies have found that this is not the case.

Most of the H-1B visas sought by the Indian applicants are in the field of technology. They aim at working in Silicon Valley. The US has a strict immigration system and so they select very few employs to work in these sectors. Other sectors take an even lesser number of immigrants. So, the employment levels of native-born workers are safe and secure.

Is the H-1B Visa a Permanent Visa?

No, the H-1B visa allows you to work for up to 6 months in the US. It acts as a trial period for high-skilled immigrants. You get to establish yourself and apply for a permanent residence.

Why does the US Need More of H-1B Visa Migrants?

It is a well-known fact that the Indian and Chinese migrants contribute highly to the US economy.

They help in giving rise to patent attributes. The patents with the Anglo-Saxon names do not fall by this. (2010 study by economists William Kerr and William Lincoln).

It has also been shown that companies that win the H-1B visa lottery tend to get higher venture capital funding, produce more patents, and are more successful. (Study Paper by economists Stephen Dimmock, Jiekun Huang, and Scott Weisbenner).

Do the H-1B Visa Employees Help the Natives?

Yes. Many studies show that H-1B visa workers tend to help the natives. Allowing more H-1B visa workers raises the wages of native workers who are highly skilled. It doesn’t hurt their employment levels. This is due to a phenomenon called the cluster effect.

The more H-1B visa workers move to a city, the more the tech companies locate their offices and research facilities in that city. It raises local productivity and brings a rise in wages.

Should the US welcome more H-1B visa workers?

US productivity growth and business formation are low. At such a time it needs to welcome the H-1B visa workers who bring in innovation to these companies.

The H-1B visa cap fell from 200K applicants to 85K applicants. It hasn’t been raised ever since.

Trump Policy in Action

The denial rates of the H-1B visa applications are continuously rising. Donald Trump has openly stated his views on immigrants. The denial rate rose from 10% in 2016 to 30% in 2019. The cap of 85K is being met each year as the applications are on the rise and many of the denials are overruled. But the Trump Administration is trying to reduce the inflow of the skilled workers.

Why the Hostility?

The opinion polls conducted in the US show overwhelming support for immigration. But the hostility may have something to do with the race of immigrants. China and India together constitute more than 85% of the total H-1B visa petitions. The concern is that most of the visas go to outsourcing companies who add little to American innovation. H-1B program has a link to indentured servitude. The US companies employ foreign workers to hold down the pay.

The workers accept less pay compared to their foreign counterparts as they fear that they will be forced to leave the country and so are unable to change jobs.

Is the Criticism Valid?

No. There had been a change in the H-1B visa law in the year 2000. H-1B visa workers can change companies and start working before the paperwork is done.

They also get to stay for 60 days to find a new job in case they are laid off.

How to apply for a medical professional work visa?

Choose the appropriate work permit

You need to select the appropriate work permit. There are two options for this- Employer specific work permit and Openwork permit. The selection will depend on whether you have a job offer or not and which immigration program you chose for immigration.

Meet the Eligibility Requirements

You need to prove that you will leave once your work permit expires

You should have enough funds to support you and your family members

You need a police clearance certificate for security reasons

You need a medical exam certificate to show that you are in good health.

Meet the Additional Requirements

You need an IELTS certificate for English language skills.

You need to have a work experience certificate

You need an assessed medical degree listed on the World Directory of Medical Schools

You need assessed credentials by the Medical Council Of Canada

If you do not have the credentials, then you need to complete a one-year post-graduate program in a Canadian province.

Which are the immigration programs that medical professionals should apply through?

Express Entry System

This program was launched in 2015 to simplify and speed up the immigration process. It caters to the highly skilled foreign applicants who wish to live and work in Canada. The applicants applying for a work visa through this program can apply for an open work permit. This system does not need candidates to have a Canadian job offer beforehand.

Please note that having a job offer can increase your Comprehensive Ranking (CRS) Score. This further increases your chances to get an Invitation to Apply (ITA) for a Permanent Residency (PR) in Canada.

Provincial Nominee Program

This is a program of the specific provinces which target certain professionals according to their market needs.

The candidates who do not qualify for the Express Entry System can apply for this program. But you need a job offer and relevant work experience.

You should check whether your job title is listed in a particular province’s in-demand occupation list. This will increase your chances of a provincial nomination.

A provincial nomination awards you with 600 extra points in your CRS score. This further guarantees you to get an ITA for a permanent residency in Canada.

Conclusion

If you are a medical professional, then immigrating to Canada is a simple and easy process for you. Do follow the procedure that has been mentioned in detail above. You should know beforehand about which province you wish to live and work in. This will increase your chances of getting an ITA for permanent residency in Canada.

Every year many Indians travel to Canada with the aim of settling there. Canadian Immigration System is a point-based immigration system and so your immigration scores impact your chances of permanent residency in Canada. Selecting the right program suiting your profile is also important to gain access to a permanent visa.

What are the Eligibility Factors?

You must get 67 out of 100 points to be eligible for the PR visa. The point-based system looks into factors like qualification, work experience, language skills, adaptability, etc. The maximum points are mentioned below:

Age- 12 points

Education- 25 points

Work Experience- 15 points

Language Skills- 28 points

Adaptability- 10 points

Arranged Employment- 10 points

Which are the Best Canadian Immigration Programs?

If you see the figures of native Indians gaining permanent residency in Canada, you will notice that most of the applicants were successful when they applied through the Federal Express Entry System of Canada.

In 2018, more than 39,600 Indians got permanent residency through the express entry system which is an increase of about 50 percent from the 26,300 Indians who gained residency in 2017. (https://blog.visasavenue.com/which-is-best-visa-program-for-indians-to-get-permanent-residency-in-canada/)

Basic Eligibility for the Canadian Express Entry Program:

Age under 40 years

Graduation in any stream

2-3 years of work experience

Good English Language Skills

Financial Stability

What is the Federal Express Entry System of Canada?

The express entry system is a point-based system for immigration in Canada. It is the fastest way through which skilled workers can gain permanent residency in Canada.

The candidates need to register their profile and are then awarded points based on the Comprehensive Ranking System (CRS) after which the profiles move into the express entry pool.

The express entry draw is carried out every 15 days whereby the Canadian government or IRCC (Immigration Refugees and Citizenship Canada) invites the top-ranked candidates to apply for permanent residency in Canada.

Apply in Provincial Nominee Programs

Express Entry System is a federal program run by the Canadian government whereas PNP is operated by provinces of Canada in coordination with the federal government.

The PNPs are awarded with annual nomination quotas according to which they invite, select, and nominated the selected pool of talented candidates for permanent residency.

The benefit here is that a candidate can be selected even if he/she has a low immigration score with relaxed process requirements.

It is best to apply in the Express Entry aligned stream of the respective PNPs.

How to Increase Your CRS Score?

Apply in a PNP to get provincial nomination

If you apply and are selected through the express entry aligned stream of a PNP, you get 600 extra points in the express entry system which improves your CRS score.

Be proficient in languages

You can enhance your chances of getting a permanent residency visa by working on IELTS score. You can also provide the IELTS score of your spouse to get extra points. Being proficient in the French languages also helps you to earn bonus points in express entry.

Get an Employment Offer

If you are able to get an employment offer from a Canadian province, you get 200 extra CRS points which are a huge plus to your immigration score.

Quebec Skilled Worker Visa Program

Under the Quebec Immigration 2019 rules, Quebec aims to invite thousands of skilled workers into the province to immigrate at a faster pace. The minimum requirements for this program are:

Education- Diploma or Bachelors

Work Experience- Minimum 6 months

Age- Up to 42 years

Language Ability- French and English

Conclusion

Thus for any candidate aspiring for a permanent residency visa to Canada, it is a must that he/she meets the least requirements and is able to score well in the CRS point-based system. And if they score less the programs mentioned above can help them to improve their chances of success.

Immigration to Canada is a clear cut procedure. The government has added further simplifications to attract migrants. The two most important immigration programs of Canada are – Express Entry System and the Provincial Nominee Program (PNP). The Express Entry System is a government-operated system for immigrants. The PNP is a province-specific program tailored to the needs of provinces. PNPs are usually for skilled workers. Saskatchewan is a popular province of Canada with a booming economy. It has plenty of natural resources like minerals, oil, natural gas, and potash. The province provides a reasonable cost of living and plenty of jobs.

What is the Work Structure of a PNP?

If you are nominated through a PNP, you get 600 extra points under the Comprehensive Ranking System (CRS). This increases your chances of getting an ITA (Initiation to Apply).

This program is for those who:

Have the skills and education required to contribute to the economy

Want to live in a particular province

Want to become permanent residents of Canada and can adapt to the lifestyle

Each province has its own streams whereby they target certain groups like

Students

Business people

Skilled workers

Semi-skilled workers

The categories under the SINP are as follows:

International Skilled Worker Category

Entrepreneur Category

Farm Worker Category

We will be looking into the category that invites application for the skilled workers through its PNP known as the Saskatchewan Immigrant Nominee Program (SINP).

What is the Procedure for the Application?

You must meet the edibility criteria of the province to which you wish to apply

Submit an Express Entry Profile

Meet the minimum criteria of Express Entry

If you are invited to apply, submit an electronic application to Immigration Refugees and Citizenship Canada (IRCC)

There will be a SINP Expression of Interest (EOI) draw

If selected, you will receive SINP nomination and get 600 extra points under Express Entry CRS.

You will then get an ITA for permanent residency (PR) to Canada.

What are the Eligibility Criteria to Immigrate to Saskatchewan?

There is a general eligibility criterion common to all the PNPs which are as follows:

Age- 12 points

Level of Education- 23 points

Work Experience- 15 points

Language Proficiency(English and French)- 20 points

Connection to Saskatchewan and Adaptability- 30 points

There are marks awarded on the basis of these general criteria. Total marks are 100 and a minimum of 60 marks is needed to proceed further.

The criteria for Saskatchewan, in particular, are as follows:

Get a minimum language score of 4 on the Canadian Language benchmark
