The UK is one of the finest countries to relocate to. Many Indians have been living a life of their dreams in the British empire of the United Kingdom. Yet, in the past few years, there has been a ‘shift of preference’ in the minds of people. Many immigrants in the UK are now opting to relocate to Canada. There are a few prominent reasons for this:

1. Negligible unemployment in Canada

The Canadian economy has been growing by leaps and bound. The country is full of opportunities, especially for ITs, teachers, nurses and accountants. The grade & pay system in Canadian firms is great! The unemployment rate is negative in the country and even by any chance, if you are not employed, the Canadian government will provide you with the unemployed allowance. These facilities are lacking in the UK, as it is an established economy. In the world of economics, the developing economy is more capable of employment generation than the established economy.

2. Brexit deal

The on-going Brexit deal in Britain may lead to many economic changes in the county. There may be a direct impact on the people of the economy. Brexit is a deal that has been initiated by Great Britain, seeking to divide its territory from the European Union. Since Britain is now on the closing stage of the deal, the country will now become an independent entity. While a majority of people of Britain had voted for the separation, Indians may find it uncomfortable to immigrate to the UK at this point in time.

3. Social Security Benefits in Canada

One of the most popular attraction points in Canada is not the Nigeria fall but the social security benefits that the county provides to its Permanent Residents. Some of the popular social schemes by the country are:

Free healthcare services

Free education up to 12th standard

Unemployment allowances

Retirement benefits

Child allowances up to CAD 800 if your child is born in Canada

4. Zero discrimination policy in Canada

Canada is a known multi-cultured nation. People from all over the world- China, South Africa, Dubai, India, Russia, and the Americas, immigrate and settle in Canada. There is zero discrimination on the basis of color, creed, religion and cultural practices. In fact, a huge Indian community is living in the heart of Canada i.e., Manitoba province, where 3rd official language is Punjabi! What’s more, is that the Mayor of the Winnipeg city of Canada is always an elected North Indian for a decade now!

While in the UK, there still exists discrimination for Indians; Canada is a ‘home away from home’ that caters to the Indian community, their festival celebrations, religion establishments as well as community centers within.

The Brexit situation in the UK has taken everybody for a ride. There is fear and confusion all around. But […]

The Brexit situation in the UK has taken everybody for a ride. There is fear and confusion all around. But the UK authorities are doing their best to settle this confusion.

What was the Queen’s speech about?

The speech was given by the Queen on 14 October 2019 was to assure the UK citizens that its government will implement a fair, modern, and global immigration system. It was to set the government’s agenda for the parliamentary year. It included 26 bills that cover policies on immigration, crime, health, environment, and Brexit.

Which immigration system will the UK adopt?

Prime Minister Boris Johnson and the Home Secretary Priti Patel, through their announcements, have made it clear that the UK will have a points-based immigration system.

This system is similar to that of the Australian immigration system. Under this, the migrants from the European Union will be treated at par with migrants from other countries like India. This system will award points based on the English language skills and professional qualities of the immigrants. It will try and fill only the skill shortages in the country.

What is the view of the hard Brexiteers?

They were always of the view that once the UK leaves the 28-member economic bloc, it will be able to implement a fairer immigration system. The system will come directly under the UK government and there will be no discrimination against the country of origin of applicants. There will be harsher sentences for foreign criminals and violent offenders. The government also plans to cut down the plastic pollution.

What was Boris Johnson accused of?

Boris Johnson got accused of using the Queen’s speech as an excuse to suspend Parliament sitting to avert the scrutiny on Brexit.

The Supreme Court had ruled the suspension unlawful. In order for Brexit to be successful, Johnson has to strike a deal with the EU at the Brussels summit and then introduce an EU withdrawal agreement bill. It then has to ensure it secure passage through Parliament.

Where does the Problem lie?

The major problem lies in arithmetic. The Conservative Party does not have a majority in the House of Commons and so the passing of any bill in the parliament is going to be a struggle.

The UK is facing a crisis with its Brexit deal still pending. There are many questions and queries that remain […]

The UK is facing a crisis with its Brexit deal still pending. There are many questions and queries that remain unsolved. Will the Brexit deal take place? What happens if it doesn’t? Can the UK travelers enter the EU without a job offer after Brexit? What are the systems put in place to deal with the UK visa issues? Will there be free movement after Brexit?

The citizens of the UK are confused and this confusion only seems to be increasing. In this article, we will try and solve some of your queries. Read further to know about the situation after Brexit.

Will there be free movement after Brexit?

The United Kingdom is scheduled to leave the EU on October 31, 2019. The Queen gave a speech on 14 October 2019 which marked the State Opening of Parliament. She stated that a new UK visa and immigration bill will be introduced that will end free movement between the UK and EU, once we leave the EU.

She also said that a point-based immigration system will be put in place from 2021.

What about the European citizens?

The Queen stated that the European citizens who have built their lives in the UK and have contributed so much to its economy will have the right to remain. The government of the UK is working in this direction.

But the EU citizens will be subject to the same visa and immigration controls as the non-EU citizens from January 2021. The citizens of Ireland will be exempt from these conditions according to the new bill. There will be free movement with Ireland.

What does Australia have to do with this?

The point-based system that the UK plans to launch from 2021 is like the Australian immigration system. Apparently the Australian government has been advising the UK Home Office on how this system could operate.

How will the point-based system work?

A point-based system is a way of ranking and prioritizing applicants for work visas.

The points-based system works in Australia to attract the highly skilled workers who could add value to its economy and fill skill shortages.

Australia only wanted to invite younger applicants. One of the key categories of its immigration program is the factor of age. The country wanted applicants under the age of 50 years. Younger applicants get 30 points and those approaching the age of 50 get zero points. Being proficient in English is also a major category in the program. If you are able to read and write English to a satisfactory standard you get good points. If you have a superior grasp on English you get even more points. Under this system, your educational qualification and work experience matter a lot. Better qualified candidates are preferred.

What will the UK immigration system look like?

The Conservative party has time and again expressed its inclination towards the Australian immigration system. The Home Secretary Priti Patel has also made it clear that they plan to introduce an immigration system like Australia’s.

The UK government wants an immigration system that invites leading people in their fields to fill the skill shortages where they are needed the most. They want the system to work in the interest of Britain. They want a system that is under the control of the British government.

Why are the employers still confused?

Many employers have been left confused by this announcement. They said that the announcement was very vague. The UK already has a similar system in place under the Tier 2 category. They are in confusion about how the UK plans to go about its immigration system and what new changes will be brought about.

A clear indication is yet to be given by the authorities. This leaves the employs in a very unsafe place.

A restrictive point-based system might be put in place which requires all workers to be under the sponsorship of their employers and meet the point-based skills threshold. This system invites only a selected few to the UK. There are still doubts about whether such a system will ever be put in place due to UK politics and the general elections taking place in the coming weeks.

Every day the UK comes close to leaving the European Union (EU). The UK Prime Minister Boris Johnson is putting […]

Every day the UK comes close to leaving the European Union (EU). The UK Prime Minister Boris Johnson is putting all his efforts to close the Brexit deal by October 31. There might be delays in leaving the EU, but let us take a look at what will happen to the travelers once the UK does leave the EU. Will the travel become easier or will there be many disruptions?

The passport checks might become easier but many other elements like driving license validity, health insurance, custom rules will change drastically. So let us see how will travel to Europe change after the new Brexit deal if the UK leaves Europe with or without a deal. Here are answers to the most common FAQs,

Should you travel to Europe in the first place?

If the UK leaves Europe with a deal by October 31, it will enter a transition period till December 2020. This means that travel facilities will continue to work without disruptions. If the UK leaves without a deal, the EU confirms that the UK airlines will continue to travel between the UK and Europe under contingency legislation.

So booking a holiday to Europe should not be a problem. Hotels and airlines might even cut prices to attract customers. But travelers should wait till winter or next summer to avoid any problems. There is no guarantee of how the pound will fare after a no-deal Brexit.

What about the disruption at airports?

There won’t be disruptions at airports but there could be delays at key airports. This will be because the British passports will be processed differently.

The European Tourism Association (ETA) says that additional checks will add 90 extra seconds for each UK passport holder. This adds up to five additional hours for 189 passengers to get the green light on a typical day. The flights will operate as usual which is positive news to the one that said that all flights to the EU from the UK might be grounded.

Will you as a UK citizen need a new passport?

It is preferable that travelers should have a passport that has at least 6 months of validity after October 31.

The Home Office has also issued a new directive. It says that if you renewed your passport before the expiry, up to nine months may have been added to your passport’s new expiry date. But please note that any extra month that is added over the 10 years will not be counted for the six months that should be remaining for travel to most countries in Europe.

This is a directive for the no-deal requirements. Travelers are advised to renew their passports before the expiry date to avoid any unnecessary delays. The website created by the Home Office for travelers to check their passport validity is- https://www.passport.service.gov.uk/check-a-passport

What about travel through other means of transport?

Ferries and cruises will continue to operate as usual. These are run by the international rules and not the EU rules. Coaches and trains will also run as usual. But to be on the safe side, you must check with your travel company for any additional rules.

Which countries will be affected by Brexit?

A British passport holder which travels to any country in Europe or in a part of the Schengen area will be affected. These include the following:

Austria

Belgium

Czech Republic

Denmark, Estonia

Finland

France

Germany

Greece

Hungary

Iceland

Italy

Latvia

Liechtenstein

Lithuania

Luxembourg

Malta

Netherlands

Norway

Poland

Portugal

Slovakia

Slovenia

Spain

Sweden

Switzerland

Will I need a Visa now?

No, the UK citizens won’t need a visa to travel to Europe. You can visit the EU for up to 90 days within a 180-day period without a visa. The European Commission has announced that from 2021 you will need to pay a fee of 7 pounds for visa-exempt travel.

What about travel to the Republic of Ireland?

The travel to the Republic of Ireland will not be affected. Travel between the UK and Ireland comes under the Common Travel Area Rules and the EU Rules. So no passport is needed for that. This will remain the same even after we leave the EU.

Will my travel insurance cover any damages due to Brexit?

This depends on the exact situation and the level of cover you have. The best way to stay protected is by booking a package.

If you book a package, your holiday will be protected under the Package Travel Regulations. This means that you will be refunded if your holiday cannot be provided. The authority will also ensure that you get an alternative trip if the original trip cannot go ahead. It is important that you have adequate travel insurance cover. You should also check policies relating to travel disruptions or delays.

What about my EHIC card?

The European Health Insurance Card (EHIC) enables UK citizens to get reduced-cost treatment in other EU countries. The UK government has said that it will continue to keep a similar arrangement after Brexit.

If we leave the EU without a deal then the UK registered EHICs will no longer be valid. In this case, you are advised to have adequate travel and medical insurance cover to cover your medical costs.

Will my driving license remain valid in Europe?

You are required to carry a Green Card so that your car insurance is applicable in the EU. To get the Green Card you may need to pay a small administration fee.

Traveling without a Green Card will amount to breaking a law and you may face persecution. Please note that in the event of a no-deal, your UK driving license will no longer be valid in the EU. In that case, you will have to get an International Driving Permit (IDPs), with a different document for different countries. The IDPs come in 1949 and 1968 versions. They can be obtained from the post office at a cost of about 6 pounds.

What are some of the other issues that you should be aware of?

Pay higher airfares

The trend of reducing airfares and new routes being opened up between the UK and EU will no longer be available to travelers. This means higher airfares for you.

A weaker pound

The UK citizens are facing a depressing pound. In June 2016pound bought 1.30 Euros, now the rate is 1.16 Euros. This is bad news for the British and especially for travelers.

No free roaming

You may not get free roaming after Brexit to the EU countries. Vodafone, O2 and Three have indicated that they will continue with free-roaming. The government has said that it will cap data charges at 45 pounds a month for those that do not.

You need a working visa

It is inevitable that the UK citizens will face restrictions of freedom of work and movement. You will, thus, need a working visa to live and work in the EU.

Pets to Europe

If you want your pet to travel with you to Europe, you will have to get a document signed from an Official Veterinarian at least 4 months in advance of travel.

Duty-free and guilt-free shopping

All UK citizens will now have to pay a duty to bring home goods from the EU. You get a duty free allowance of 200 cigarettes, 16 liters of beer and 4 liters of wine. Above that, you pay 2 pounds for each bottle of wine brought home.

How to avoid any consequences of Brexit?

You can choose to travel to those countries which are not affected by the UK leaving the EU. These countries are low in number. Iceland, Norway, Switzerland, and a small part of Balkan remain outside the EU.

Other options for travel are as follows:

Istanbul, Marrakech, St. Petersburg are the places where you can take a city break. These are wonderful cities that you can enjoy without any hassles from the EU documents. The beaches of Morocco are also welcoming UK citizens with open arms and simplified procedures after Brexit.

When traveling abroad you are bound to come across various types of backpackers with whom every trip becomes memorable. Backpackers are different from tourists in the sense that they usually travel in big groups to maximize their budget, try and experience the not so popular destinations as well, and live in tacky hostels socializing all the time.

Even among backpackers, there is a variety of personalities that you can come across. Below are the 10 types of backpackers that can amaze you.

The Gilbert Species

Anybody who has read the book- Eat, Pray, Love by Elizabeth Gilbert can identify with this kind of species. These travelers are usually in the 18-25 age groups who take a gap year just after or before college to explore the world.

Though this spontaneous plan to take a sabbatical can happen at an older age too. Nervous break-downs or reunions being the common reasons. Zindagi Na Milegi Dobara comes to mind.

These over-enthusiastic backpackers and explorers are usually from Europe, New Zealand, Australia, and America, following round-the-world ticket route, spending most of their time in Southeast Asia, New Zealand, and Australia.

These species tend to party a lot, sleep in dorms, see the main attractions, meet other travelers, and come home with a few good stories to share before they begin their college or career.

The Volunteers

The Partyholics

They spend most of their time getting drunk in each new destination prioritizing their late-night drinking and socializing above all else. They are sure to know the best clubs, bars, happy hours in a country and are usually found in party destinations like Amsterdam, Thailand, Barcelona, and Prague.

The Penny-Pinchers

Their treasure includes high-end clothing, accessories, and gadgets. Their nights are reserved for fancy dinners and extravagant excursions which do not match their stay in $10 per-night tacky hostels.

These are the luxurious backpackers oozing out wealth and richness along every step of the way.

The Grannies

Most of the backpackers you are bound to find will be in their 20s or 30s. But among them, you are sure to come across the grannies or the oldies too. These travelers can afford to stay in high-end hotels but prefer cheap hostels due to their youthful energy, and communal spaces.

These oldies and midlifers are back on the road to once again experience their lost youth or take a leave from their fast-paced corporate lives. Lucky for you as they have some amazing stories to share.

Or they can be the reserved kind of couples who only want each other’s company and do not like being involved in the hostel parties. They usually book the deluxe private hostel rooms and want their privacy to be respected at all times.

The Hermione Species

These kinds of travelers are the know-it-all backpackers who always travel in similar ways and stay in hostels. They cannot be challenged in their history of travel and are thus unbeatable. They can tell you about the times when they went swimming with sharks when you have just been to scuba diving.

Even though they might appear to be haughty, they have a reservoir of useful information and can give you the best recommendations. Being on their good side won’t hurt you.

The Spiritualist

These backpackers are usually western, white, and young. Exhausted by the materialism in their world they travel to find inner peace and live a life of stoicism. They explore the local customs and cultures, read books on Buddhism and spiritualism.

Their usual destinations are temples and ashrams where you can find them doing yoga or chanting mantras. These travelers are known to have done ayahuasca in South America and yoga in Bali.

Travelers Spiritus forgo their material possessions to find themselves and blog about their new and healthy lifestyle. They boast as to how freer they feel and are usually found in South America, India, and Southeast Asia.

The Hippies

The Digital Nomad

This species is the rebellious kind who has broken free from the 9 to 5 job and have taken up location-independent, technology-enabled jobs. They work online to afford their travels and can be found on social media boasting their free lifestyle, posting beach photos on Instagram with captions like “Just another day at the office”.

They spend much of their time behind laptops and never experience the destination they are at. They live wherever there is good internet access and cheap hostels.

Britain is known as the business center of the world and so naturally tops the list of best countries to work in for the immigrants. With a great nightlife and an exotic foodie culture, it is the dream destination of many employees.

So, it is important to know the British work culture which can vary hugely from the US and Europe. Read on to find out.

1. The Chatty Brits

The British are known for their straightforward talks on data and numbers but they love their chit-chats. So before getting to the crux of the matter, they spend five to ten minutes exchanging niceties. Remember, the Brits are way too well mannered.

2. Cheers Mate!

The U.K. has a widespread drinking culture and so it is not unusual to find their pubs filled with corporate bees mingling with each other or having a nice time. They believe in blowing off the steam and enjoying the end to a workweek by downing glasses of pints. So go mingle with these bees and enjoy yourself mate.

3. Seniority Matters Senorita

The Brits believe and rigorously follow their hierarchy system. You only have to take a look at the Royal Family to get the gist. They might have friendly chats in the workplace but at the end of the day never forget who the boss is. In fact, for them, seniority matters more than credentials.

4. Team Spirit is Crucial

The Brits are very proud of their morals like fairness and equality. They believe in team spirit and bring this quality in business too. Though hierarchy is present, team spirit is not too far. So, boasting about your individual achievements is not such a good idea and giving credit to the team is a plus point.

5. Work Hard, Party Harder

The British work hard but they party harder. They follow strict working hours of Monday to Friday 9 AM to 5 PM. It is very rare to find a Brit working on weekends and they would never give up a single day of their yearly four weeks leave.

You do not need to sacrifice your holidays or weekends to show your dedication to the job. So relax mate!

A visit/tourist visa is different from a work visa. Every year many people apply for a tourist visa to the […]

A visit/tourist visa is different from a work visa. Every year many people apply for a tourist visa to the UK but are denied it due to various reasons. Sometimes you may be denied the visa on unjustified grounds. This is where legal agents can help you get your visa accepted.

You have three options in case you are denied a visit visa to the UK-

Reapply

Appeal

Judicial Review

When can Judicial Review be Pursued?

It can only be pursued when you have no alternative remedy. It is a challenge to the lawfulness of the court and the judge will see whether the law has been correctly applied or not.

No further evidence can be submitted at this stage and this review needs to be filed within three months of refusal decision.

Why Go For a Judicial Review?

If you have already been denied the visa then making a new application would make less sense as the Entry Clearance Officer (ECO) of the UK would take refusal decision as the starting point and is likely to refuse a new application if previous concerns have not been addressed.

You can file for an appeal and since July 2013 you can lodge an appeal for the visit visa to the UK, on human rights grounds. This appeal will go to the Home Office of the UK and it may so happen that after months of waiting, the judge decides that human rights cannot be engaged in your case.

And so when a new application or an appeal is unsuitable or time-consuming and risky in your case, a judicial review may be appropriate.

Pre-Action Protocol

Before lodging a judicial review a “letter before claim” should be sent to the Home Office to reconsider their own decision. The ECO may overturn the decision after reviewing the grounds. A minimum of 14 days is taken by the Home Office for this and this letter may lead to overturning the decision which means you will get the visa without the court being involved.

If the decision is maintained or there is no response then you can file for the review.

Arguably Grounds for Unlawful Decision
