The UK is one of the finest countries to relocate to. Many Indians have been living a life of their dreams in the British empire of the United Kingdom. Yet, in the past few years, there has been a ‘shift of preference’ in the minds of people. Many immigrants in the UK are now opting to relocate to Canada. There are a few prominent reasons for this:

1. Negligible unemployment in Canada

The Canadian economy has been growing by leaps and bound. The country is full of opportunities, especially for ITs, teachers, nurses and accountants. The grade & pay system in Canadian firms is great! The unemployment rate is negative in the country and even by any chance, if you are not employed, the Canadian government will provide you with the unemployed allowance. These facilities are lacking in the UK, as it is an established economy. In the world of economics, the developing economy is more capable of employment generation than the established economy.

2. Brexit deal

The on-going Brexit deal in Britain may lead to many economic changes in the county. There may be a direct impact on the people of the economy. Brexit is a deal that has been initiated by Great Britain, seeking to divide its territory from the European Union. Since Britain is now on the closing stage of the deal, the country will now become an independent entity. While a majority of people of Britain had voted for the separation, Indians may find it uncomfortable to immigrate to the UK at this point in time.

3. Social Security Benefits in Canada

One of the most popular attraction points in Canada is not the Nigeria fall but the social security benefits that the county provides to its Permanent Residents. Some of the popular social schemes by the country are:

Free healthcare services

Free education up to 12th standard

Unemployment allowances

Retirement benefits

Child allowances up to CAD 800 if your child is born in Canada

4. Zero discrimination policy in Canada

Canada is a known multi-cultured nation. People from all over the world- China, South Africa, Dubai, India, Russia, and the Americas, immigrate and settle in Canada. There is zero discrimination on the basis of color, creed, religion and cultural practices. In fact, a huge Indian community is living in the heart of Canada i.e., Manitoba province, where 3rd official language is Punjabi! What’s more, is that the Mayor of the Winnipeg city of Canada is always an elected North Indian for a decade now!

While in the UK, there still exists discrimination for Indians; Canada is a ‘home away from home’ that caters to the Indian community, their festival celebrations, religion establishments as well as community centers within.

If you are willing to immigrate to Canada from the UK, contact us straight away! We shall evaluate your credentials by preparing an assessment report. Call us or send us an email and we shall arrange a call back for you!

The famous slogan of the US President Donald Trump, “Buy American Hire American” was hailed as the beginning of a new era. An era in which the native-born workers won’t be exploited by the immigrants anymore. The President promised to reduce the flow of immigration to the US. A major reason for this is that he thinks the immigrants take up all the jobs of Americans and reduce the pay for the natives.

What are the H-1B Petitions for Initial (New) Employment?

They are the primary cases of the H-1B annual limit of 65,000 and the 20,000 exemption from the limit for foreign nationals who got advanced degrees from US universities.

The initial petitions account for the new employment. The continuing petitions account for continuing employment, change of employer, and amended petitions.

What are the denial rates?

The immigration service of the US, U.S. Citizenship and Immigration Service (USCIS) has set new records in denying the H-1B primary petitions.

It is shocking to note that the rates have risen from around 6% visa refusals in 2015 to around 24% visa refusals in 2019 according to the National Foundation for American Policy analysis (https://nfap.com/wp-content/uploads/2019/10/H-1B-Denial-Rates-Analysis-of-FY-2019-Numbers.NFAP-Policy-Brief.October-2019.pdf).This is a high jump. Trump Administration is responsible for this.

Table 1: Shows the Denial Rate for H-1B Petitions for Initial (New) Employment

10%

FY 2015

6%

What are the denial rates for continuing petitions?

The denial rates for continuing petitions are also on the rise. This has ended the career of thousands of people, forcing them to leave the country.

The denial rates have risen from 3% in FY 2015 to 12% in FY 2019.

Table 2: Shows the Denial Rate for H-1B Petitions for Continuing Employment

FY 2015

3%

Which companies are affected by this?

The denial rates have increased for companies in all sectors. The sector which is the most affected is Information Technology (IT). The government has singled out this sector for restrictive immigration policies.

These companies had denial rates of 2% to 3% in FY 2015. This increased to over 30% in the first three quarters of FY 2019.

What is the reason for this denial?

The reasons are that the USCIS has raised the legal standards to decide whether enough evidence has been given to approve the petitions. They do not have the legal authority to do this. They did not issue any public notice either. No law was passed in Congress. They silently refused the petitions without telling the public as to why they are being denied visas.

A Freedom of Information Act (FOIA) lawsuit was filed by the American Immigration Lawyers Association.

Following this, the USCIS released documents in September 2019. It was shown that the agency made dramatic changes to the H-1B policy without accounting for these changes in the law.

Table 3: Quarter Wise FY 2019 Denial Rate for H-1B Petitions for Initial (New) Employment

27,707

24%

What does the future hold for H-1B petitions?

It is anticipated that a higher denial rate of initial petitions for the fourth quarter of FY 2019 is to turn up. This shows that the Trump Administration is committed to denying the foreign-born scientists and engineers to work in America. In the coming months, the procedure for hiring foreign-born individuals is to become more restrictive.

How to apply for a medical professional work visa?

Choose the appropriate work permit

You need to select the appropriate work permit. There are two options for this- Employer specific work permit and Openwork permit. The selection will depend on whether you have a job offer or not and which immigration program you chose for immigration.

Meet the Eligibility Requirements

You need to prove that you will leave once your work permit expires

You should have enough funds to support you and your family members

You need a police clearance certificate for security reasons

You need a medical exam certificate to show that you are in good health.

Meet the Additional Requirements

You need an IELTS certificate for English language skills.

You need to have a work experience certificate

You need an assessed medical degree listed on the World Directory of Medical Schools

You need assessed credentials by the Medical Council Of Canada

If you do not have the credentials, then you need to complete a one-year post-graduate program in a Canadian province.

Which are the immigration programs that medical professionals should apply through?

Express Entry System

This program was launched in 2015 to simplify and speed up the immigration process. It caters to the highly skilled foreign applicants who wish to live and work in Canada. The applicants applying for a work visa through this program can apply for an open work permit. This system does not need candidates to have a Canadian job offer beforehand.

Please note that having a job offer can increase your Comprehensive Ranking (CRS) Score. This further increases your chances to get an Invitation to Apply (ITA) for a Permanent Residency (PR) in Canada.

Provincial Nominee Program

This is a program of the specific provinces which target certain professionals according to their market needs.

The candidates who do not qualify for the Express Entry System can apply for this program. But you need a job offer and relevant work experience.

You should check whether your job title is listed in a particular province’s in-demand occupation list. This will increase your chances of a provincial nomination.

A provincial nomination awards you with 600 extra points in your CRS score. This further guarantees you to get an ITA for a permanent residency in Canada.

Conclusion

If you are a medical professional, then immigrating to Canada is a simple and easy process for you. Do follow the procedure that has been mentioned in detail above. You should know beforehand about which province you wish to live and work in. This will increase your chances of getting an ITA for permanent residency in Canada.

Immigration to Canada is a clear cut procedure. The government has added further simplifications to attract migrants. The two most important immigration programs of Canada are – Express Entry System and the Provincial Nominee Program (PNP). The Express Entry System is a government-operated system for immigrants. The PNP is a province-specific program tailored to the needs of provinces. PNPs are usually for skilled workers. Saskatchewan is a popular province of Canada with a booming economy. It has plenty of natural resources like minerals, oil, natural gas, and potash. The province provides a reasonable cost of living and plenty of jobs.

What is the Work Structure of a PNP?

If you are nominated through a PNP, you get 600 extra points under the Comprehensive Ranking System (CRS). This increases your chances of getting an ITA (Initiation to Apply).

This program is for those who:

Have the skills and education required to contribute to the economy

Want to live in a particular province

Want to become permanent residents of Canada and can adapt to the lifestyle

Each province has its own streams whereby they target certain groups like

Students

Business people

Skilled workers

Semi-skilled workers

The categories under the SINP are as follows:

International Skilled Worker Category

Entrepreneur Category

Farm Worker Category

We will be looking into the category that invites application for the skilled workers through its PNP known as the Saskatchewan Immigrant Nominee Program (SINP).

What is the Procedure for the Application?

You must meet the edibility criteria of the province to which you wish to apply

Submit an Express Entry Profile

Meet the minimum criteria of Express Entry

If you are invited to apply, submit an electronic application to Immigration Refugees and Citizenship Canada (IRCC)

There will be a SINP Expression of Interest (EOI) draw

If selected, you will receive SINP nomination and get 600 extra points under Express Entry CRS.

You will then get an ITA for permanent residency (PR) to Canada.

What are the Eligibility Criteria to Immigrate to Saskatchewan?

There is a general eligibility criterion common to all the PNPs which are as follows:

Age- 12 points

Level of Education- 23 points

Work Experience- 15 points

Language Proficiency(English and French)- 20 points

Connection to Saskatchewan and Adaptability- 30 points

There are marks awarded on the basis of these general criteria. Total marks are 100 and a minimum of 60 marks is needed to proceed further.

The criteria for Saskatchewan, in particular, are as follows:

Get a minimum language score of 4 on the Canadian Language benchmark

One year of work experience for skilled professionals

Two years of work experience for skilled trade workers

You should have completed post-secondary education, training, or apprenticeship which is equal to at least one year of the Canadian education system

You should have proof of your professional status

You should have a settlement fund and a settlement plan

The immigration system in Australia is much like Canada. It is based on the point-based system whereby the government allocates points and then invites you to get a permanent residency (PR) visa to stay in Australia. Australia too is in need of skilled workers and so encourages the foreign skilled workers to apply for permanent residency. Many do so willingly, allured by the high standard of living and job opportunities in the country. But what if you are married and now want your spouse to stay with you? How can you bring your spouse to Australia on a permanent visa? Let us find out the relevant spouse visa categories for Australia.

Which is the relevant spouse visa category for Australia?

Australia has many categories under which a spouse can apply for a permanent visa. The categories will depend on the location of the spouse, whether he/she stays inside or outside Australia, the relationship status of the partners, visa category of the sponsor, etc.

The most common and useful category is when a spouse of an Australian permanent citizen is staying outside Australia and wishes to apply for permanent residency. The category, in this case, is a Partner (provincial) Visa (subclass 309).

What is Partner Visa (subclass 309)?

The Partner Visa Subclass 309 is the category designed for those applicants, staying outside Australia, who wish to stay with their spouse or de facto partner who is the Australian permanent resident and so want to apply for a permanent residency visa.

What are the eligibility requirements for the Subclass 309?

You as an applicant are allowed to apply for a permanent resident visa under this category only if you are married or in a de facto relationship with a person who is:

Australian permanent resident

Australian citizen

Eligible citizen of New Zealand

At the time of application, you stay outside Australia.

Is the Partner Subclass 309 a permanent visa?

No, the partner subclass 309 is not a permanent visa. It is a temporary visa allotted to you that will allow you to stay in Australia for a limited period of time.

Once in Australia, you will have to convert this visa into a Permanent Partner Visa (Subclass 100), which will allow you to live permanently in Australia with your partner.

What is the procedure to apply for a permanent visa?

Once you have applied and are selected under the Partner (Provisional) Visa (Subclass 309), you do not again have to apply for the Permanent Partner Visa (Subclass 100).

The application for both these types of visas is the same. There is a single application for both these types of visas. You are not required to pay any extra fees either as the charge is for a single application only.

The application is processed in two stages. The first year is for the processing of the temporary subclass 309 visa and the second year if for the processing of the permanent subclass 100 visas. So you are required to wait for a year to get a permanent visa.

What are the benefits of the Partner (Provisional) Visa (Subclass 309)?

This visa even though temporary allows you to:

Travel to Australia and stay there till the Partner visa is processed.

You can pursue studies in Australia. But there will not be any government funding.

Enroll for a job opportunity.

Enroll for a healthcare scheme, i.e., Medicare in Australia.

What are the key benefits of the Permanent Partner Visa (Subclass 100)?

Once you are allotted the permanent visa you can:

Live in Australia with your spouse for an indefinite period.

Study and Work in Australia.

Make an application for Australian citizenship (if you are eligible).

You can sponsor your relatives for permanent residency (if they are eligible).

Enroll yourself for Social Security Payments.

Conclusion

So if you wish to stay with your spouse who is already an Australian permanent resident, then you can do so by following the above-mentioned steps.

It is important to note that the Permanent Partner Visa will allow you to stay in Australia for a period of 5 years without restrictions. After 5 years you are required to renew the visa (if you haven’t already got an Australian Citizenship). If you do not renew your visa, you may be asked to leave the country.

The UK Prime Minister Boris Johnson is putting all his efforts to close the Brexit deal by October 31. There might be delays in leaving the EU, but let us take a look at what will happen to the travelers once the UK does leave the EU. Will the travel become easier or will there be many disruptions?

The passport checks might become easier but many other elements like driving license validity, health insurance, custom rules will change drastically. So let us see how will travel to Europe change after the new Brexit deal if the UK leaves Europe with or without a deal. Here are answers to the most common FAQs,

Should you travel to Europe in the first place?

If the UK leaves Europe with a deal by October 31, it will enter a transition period till December 2020. This means that travel facilities will continue to work without disruptions. If the UK leaves without a deal, the EU confirms that the UK airlines will continue to travel between the UK and Europe under contingency legislation.

So booking a holiday to Europe should not be a problem. Hotels and airlines might even cut prices to attract customers. But travelers should wait till winter or next summer to avoid any problems. There is no guarantee of how the pound will fare after a no-deal Brexit.

What about the disruption at airports?

There won’t be disruptions at airports but there could be delays at key airports. This will be because the British passports will be processed differently.

The European Tourism Association (ETA) says that additional checks will add 90 extra seconds for each UK passport holder. This adds up to five additional hours for 189 passengers to get the green light on a typical day. The flights will operate as usual which is positive news to the one that said that all flights to the EU from the UK might be grounded.

Will you as a UK citizen need a new passport?

It is preferable that travelers should have a passport that has at least 6 months of validity after October 31.

The Home Office has also issued a new directive. It says that if you renewed your passport before the expiry, up to nine months may have been added to your passport’s new expiry date. But please note that any extra month that is added over the 10 years will not be counted for the six months that should be remaining for travel to most countries in Europe.

This is a directive for the no-deal requirements. Travelers are advised to renew their passports before the expiry date to avoid any unnecessary delays. The website created by the Home Office for travelers to check their passport validity is- https://www.passport.service.gov.uk/check-a-passport

What about travel through other means of transport?

Ferries and cruises will continue to operate as usual. These are run by the international rules and not the EU rules. Coaches and trains will also run as usual. But to be on the safe side, you must check with your travel company for any additional rules.

Which countries will be affected by Brexit?

A British passport holder which travels to any country in Europe or in a part of the Schengen area will be affected. These include the following:

Austria

Belgium

Czech Republic

Denmark, Estonia

Finland

France

Germany

Greece

Hungary

Iceland

Italy

Latvia

Liechtenstein

Lithuania

Luxembourg

Malta

Netherlands

Norway

Poland

Portugal

Slovakia

Slovenia

Spain

Sweden

Switzerland

Will I need a Visa now?

No, the UK citizens won’t need a visa to travel to Europe. You can visit the EU for up to 90 days within a 180-day period without a visa. The European Commission has announced that from 2021 you will need to pay a fee of 7 pounds for visa-exempt travel.

What about travel to the Republic of Ireland?

The travel to the Republic of Ireland will not be affected. Travel between the UK and Ireland comes under the Common Travel Area Rules and the EU Rules. So no passport is needed for that. This will remain the same even after we leave the EU.

Will my travel insurance cover any damages due to Brexit?

This depends on the exact situation and the level of cover you have. The best way to stay protected is by booking a package.

If you book a package, your holiday will be protected under the Package Travel Regulations. This means that you will be refunded if your holiday cannot be provided. The authority will also ensure that you get an alternative trip if the original trip cannot go ahead. It is important that you have adequate travel insurance cover. You should also check policies relating to travel disruptions or delays.

What about my EHIC card?

The European Health Insurance Card (EHIC) enables UK citizens to get reduced-cost treatment in other EU countries. The UK government has said that it will continue to keep a similar arrangement after Brexit.

If we leave the EU without a deal then the UK registered EHICs will no longer be valid. In this case, you are advised to have adequate travel and medical insurance cover to cover your medical costs.

Will my driving license remain valid in Europe?

You are required to carry a Green Card so that your car insurance is applicable in the EU. To get the Green Card you may need to pay a small administration fee.

Traveling without a Green Card will amount to breaking a law and you may face persecution. Please note that in the event of a no-deal, your UK driving license will no longer be valid in the EU. In that case, you will have to get an International Driving Permit (IDPs), with a different document for different countries. The IDPs come in 1949 and 1968 versions. They can be obtained from the post office at a cost of about 6 pounds.

What are some of the other issues that you should be aware of?

Pay higher airfares

The trend of reducing airfares and new routes being opened up between the UK and EU will no longer be available to travelers. This means higher airfares for you.

A weaker pound

The UK citizens are facing a depressing pound. In June 2016pound bought 1.30 Euros, now the rate is 1.16 Euros. This is bad news for the British and especially for travelers.

No free roaming

You may not get free roaming after Brexit to the EU countries. Vodafone, O2 and Three have indicated that they will continue with free-roaming. The government has said that it will cap data charges at 45 pounds a month for those that do not.

You need a working visa

It is inevitable that the UK citizens will face restrictions of freedom of work and movement. You will, thus, need a working visa to live and work in the EU.

Pets to Europe

If you want your pet to travel with you to Europe, you will have to get a document signed from an Official Veterinarian at least 4 months in advance of travel.

Duty-free and guilt-free shopping

All UK citizens will now have to pay a duty to bring home goods from the EU. You get a duty free allowance of 200 cigarettes, 16 liters of beer and 4 liters of wine. Above that, you pay 2 pounds for each bottle of wine brought home.

How to avoid any consequences of Brexit?

You can choose to travel to those countries which are not affected by the UK leaving the EU. These countries are low in number. Iceland, Norway, Switzerland, and a small part of Balkan remain outside the EU.

Other options for travel are as follows:

Istanbul, Marrakech, St. Petersburg are the places where you can take a city break. These are wonderful cities that you can enjoy without any hassles from the EU documents. The beaches of Morocco are also welcoming UK citizens with open arms and simplified procedures after Brexit.

When applying for a partner visa there are extra certain details that need to be proved and shared with the […]

When applying for a partner visa there are extra certain details that need to be proved and shared with the authorities apart from the general information. Details regarding the nature of the household are one of them. Read further to know what it entails.

The Nature of the Household

In order to obtain a partner visa, one needs to share details of the nature of the household. This basically means that you need to write and prove as to how you and your partner live together, what do you do together and whether or not you share the responsibility for the housework.

As per the partner visa regulation, the nature of the household includes the following:

any joint responsibility for the care and support of children

the living arrangements of the persons

any sharing of the responsibility of the housework

Any joint responsibility for the care and support of children

The Immigration Department assumes that all married couples have children and therefore this is one of the criteria to be proved by the partner applying for a visa. However, you may not have children and so, in that case, you can also write as to how you take care of your pets which do help in establishing how your household is set up and run.

If you have children, then you need to write how you care for them and support them. They want to see how responsibility is shared. Getting references or statements from witnesses is always considered a plus point in your application.

The living arrangements of the persons

Under these criteria, the officer in charge wants to know about your living arrangements, i.e., whether you and your partner own your own home, whether you rent, or whether you live with other people and if so then why?

The officer wants to determine the condition of living arrangements and is concerned to find out whether the relationship is a genuine one or not.

If you and your partner live with other people then he wants to make sure that you are actually in a relationship and not just housemates. That is why information regarding the nature of your household becomes important.

Any sharing of the responsibility of the housework

The officer in charge will scrutinize your sharing of the responsibility of housework not to make any judgments in how you conduct your relationship with your partner but to know how committed and genuine your relationship actually is. The officer needs to be assured that your partner is one for life and not just some housemaid paid to do the housework.

Before writing your account of your household responsibilities make sure that you know exactly what the officer is looking for or else you may end up writing long narratives that might be genuine but not needed.
