Stuck with an Australian Visa refusal? Your application faced this rejection and now, you’re worried how your plans would get […]

Stuck with an Australian Visa refusal? Your application faced this rejection and now, you’re worried how your plans would get executed? Before even worrying, let’s first understand why your Australian visa might be rejected. Here’s a list of some common reasons for Australian visa refusal,

1. Misleading Information

Your visa application will be rejected directly if you give misdirecting or insufficient info about you. If the authorities came to discover that there is something that isn’t right, they will not only reject your application but also may charge you for visa extortion.

2. Inability to give Proof of English Language Ability

You should meet the English language capability to get an Australian visa. You have to exhibit that you have taken the compulsory tests (IELTS, for example) and scored the minimum required scores.

3. Inability to give Evidence of Financial Capacity

Your Australia visa application may be dismissed as a result of your failure to give enough proof of funds. You have to exhibit your money or financial capacity by giving proof of the bank statements. You must demonstrate your accessibility of adequate assets to pay the cost of your stay in Australia.

4. Applying through an Unrelated Program

Before applying for an Australia visa, you should be completely mindful of the program through which you are applying. Unquestionably, there is an opportunity of visa refusal in case you apply for a program that is totally irrelevant to your purpose of coming or your work capability, etc. You have to select the right program.

5. Not Meeting the Health or Character Requirements

To get the Australian visa, you should meet the character necessities as well as be a healthy individual. Medical fitness, as well as a morally good character, is fundamental to get any visa for Australia or for any other country for that matter.

You have to get character certification from the police of your nation of origin and medical fitness certification from the prescribed panel of physicians.

6. Inability to Meet GTE Requirements

One of the most well-known explanations behind visa dismissal is an inability to meet the prerequisites of Genuine Temporary Entrant (GTE). Your visa will be dismissed if you neglect to prove that you have solid ties back in your nation of origin and you will return back to your own country once your purpose of visit gets over.

7. Inadequacy of Professional Guidance

One of the biggest factors of Visa refusal or dismissal is not getting professional assistance from a visa agent. Thus, it is prudent to take the help and direction from a registered visa expert. This will improve your chances of getting visa approval.

If you are considering visiting Australia, you can take our professional direction and help.
What are these visas about? Just to be on the same page, first, let us clarify what these visas are […]

What are these visas about? Just to be on the same page, first, let us clarify what these visas are all about. H-1B visa allows the Indian immigrants to work and stay in the US temporarily for 6 months. It is seen as a gateway for permanent residence but is getting tougher by the day.

EB-5 Immigrant Investor Visa Program allows the Indian immigrant-investors to become lawful permanent residents, the green cardholders. They can do this by investing at least $500,000 or $900,000 after November 21, 2019, in a US business that employees at least 10 American workers. An E-2 visa is a non-immigrant visa program which allows a foreign individual to set up a business and work in the US at an investment of $100,000 dollars.

Why is the E-2 Visa Much More Attractive?

The process of getting an H-1B visa or an EB-5 visa is very restrictive. In addition to these restrictions, the US government is not keen on inviting immigrants from these programs.

If one looks for a simpler alternative, an E-2 visa is what attracts the immigrants. The process of getting this visa is much simpler. You apply for a Grenada passport which takes 3-6 months and then you apply for an E-2 visa.

If your business is successful in the future, your E-2 visa can be easily converted to a green card.

The E-2 visa is issued for a period of 5 years but can be renewed for a lifetime.

What are the Issues With the EB-5 Visa?

The US government announced a new limit for investment under the EB-5 visa. The minimum investment limit for Target Employment Areas (TEA) is $900,000. The areas outside TEA will have a minimum investment limit of $1.8 million.

The change took place from November 21, 2019.

The EB-5 visa is seen as an alternative to the H1-B visa. The waiting list for this visa is quite a long one. You will have to wait for many months to get this visa.

The USCIS allocates 10,000 EB-5 visas each year for those Indian investors who can invest the requisite amount and create and preserve employment for Americans. Ten full-time jobs for US workers.

Why E-2 Visa?

There is no limit on the number of E-2 visas issued each year.

The investment amount required is comparatively lower than the EB-5 visa. You do not get to become a US citizen but you can live and work in the US indefinitely.

Family members become eligible to be dependants under the E-2 visa. When the child reaches the age of 21, he/she has to apply for a separate visa. For a family of 5 people, you have to spend $600,000-$700,000 in an E-2 visa. In the case of EB-visa, you would have to spend $4.5 million.

30-40 people applied for an E-2 visa this year as compared to 5 people the previous year. The processing time of getting an E-2 visa is 2 to 3 months.

Once you get the Grenada passport, you are free to travel to Europe, China, the UK (pre and post Brexit), Singapore, Russia, and UAE without any visa. If you go through the Grenada passport route, you can legally avoid the Indian capital gains tax.

Conclusion

Thus we can see that an E-2 visa is a much better alternative to the traditional H-1B and EB-5 visas.

Immigration to New Zealand and Australia is on the rise. Many people are aspiring to settle in these two countries. […]

Immigration to New Zealand and Australia is on the rise. Many people are aspiring to settle in these two countries. The main reason for this is its convenient immigration system. The governments of these two countries are also keen to welcome skilled migrants.

Let us see the important differences between these two immigration systems.

We are comparing Australia’s Skilled Independent Program (189 Visa) with New Zealand’s Skilled Migrant Category Resident Visa.

Skilled Workers Program

An Overview: Both programs aim at attracting highly skilled candidates with work experience, educational background, and English language speaking and writing ability.

They select applicants on the basis of a point-based system.

They do not need you to have a prior job offer. You also do not need any family or state sponsor. You can submit your Expression of Interest (EOI) without these offers. But, New Zealand Skilled Visa might ask you for a job offer in most cases.

Both these visas allow you to get a permanent residency status which allows you to stay indefinitely in that country. It is a pathway to citizenship.

What are the differences between these two programs?

To apply to Australia’s 189 visa program, you need to have a skills assessment form a skills assessing authority. It ensures that your degree is equal to an Australian degree.

For New Zealand, you need to have your qualifications assessed by the New Zealand registration authority or if you are on the list of qualifications exempt from assessment, you are eligible to apply. You must be under 45 to be able to apply to Australia. If you are 55 years of age or under you can apply to New Zealand.

Points-Based System

Both these programs have a point-based system to evaluate the candidates. You need to have at least a score of 65 points for an Australian visa invitation whereas in the case of New Zealand you need to have at least 160 points to be eligible.

Passing Score

65

160

If you meet the minimum scoring points, you are eligible to submit your Expression of Interest (EOI) to these programs. But simply meeting the minimum point’s requirement does not guarantee that you will be invited to apply for and immigrate to these countries.

How different is the application process?

Australia: In the case of Australia, the invitations to apply are issued on the 11th day of each month. Candidates with the highest EOI rankings are invited to apply. If your EOI is not invited within 2 years it will expire and you have to submit a new EOI profile.

Australia has an occupation ceiling which gives an eligible occupation a maximum quota. If that quota is reached, no more applications for that occupation are invited until the next year.

After you receive an invitation to apply, you have 60 days to submit your application for Australian permanent residency to the Department of Home Affairs.

New Zealand: First, you need to complete an Expression of Interest (EOI) profile. The invitation to apply is issued on the basis of your score in the point-based system ranking (minimum 160 points are needed) and your rank in the EOI pool (first-cum-first serve basis)

If your EOI profile is not selected within a year, it will expire and you have to submit a new profile.

New Zealand invites candidates for immigration every fortnight when it conducts its EOI selection. If selected, you are eligible for permanent residency.

Processing Times and Cost

Australia: There is no EOI fee. The Skilled Independent Program charges AU$4045 for principal applicant plus an extra AU$2025 for spouse and AU$1010 per child. These applications are processed within 6 months.

New Zealand, the Skilled Migrant Category Program charges NZ$530 for Online Expression of Interest (EOI) plus extra NZ$2710 for a family application. These applications are processed within 10 months. The applicants should also expect extra costs like health exams, translation, postage, etc during the immigration process.

The famous slogan of the US President Donald Trump, “Buy American Hire American” was hailed as the beginning of a new era. An era in which the native-born workers won’t be exploited by the immigrants anymore. The President promised to reduce the flow of immigration to the US. A major reason for this is that he thinks the immigrants take up all the jobs of Americans and reduce the pay for the natives.

What are the H-1B Petitions for Initial (New) Employment?

They are the primary cases of the H-1B annual limit of 65,000 and the 20,000 exemption from the limit for foreign nationals who got advanced degrees from US universities.

The initial petitions account for the new employment. The continuing petitions account for continuing employment, change of employer, and amended petitions.

What are the denial rates?

The immigration service of the US, U.S. Citizenship and Immigration Service (USCIS) has set new records in denying the H-1B primary petitions.

It is shocking to note that the rates have risen from around 6% visa refusals in 2015 to around 24% visa refusals in 2019 according to the National Foundation for American Policy analysis (https://nfap.com/wp-content/uploads/2019/10/H-1B-Denial-Rates-Analysis-of-FY-2019-Numbers.NFAP-Policy-Brief.October-2019.pdf).This is a high jump. Trump Administration is responsible for this.

Table 1: Shows the Denial Rate for H-1B Petitions for Initial (New) Employment

10%

FY 2015

6%

What are the denial rates for continuing petitions?

The denial rates for continuing petitions are also on the rise. This has ended the career of thousands of people, forcing them to leave the country.

The denial rates have risen from 3% in FY 2015 to 12% in FY 2019.

Table 2: Shows the Denial Rate for H-1B Petitions for Continuing Employment

FY 2015

Which companies are affected by this?

The denial rates have increased for companies in all sectors. The sector which is the most affected is Information Technology (IT). The government has singled out this sector for restrictive immigration policies.

These companies had denial rates of 2% to 3% in FY 2015. This increased to over 30% in the first three quarters of FY 2019.

What is the reason for this denial?

The reasons are that the USCIS has raised the legal standards to decide whether enough evidence has been given to approve the petitions. They do not have the legal authority to do this. They did not issue any public notice either. No law was passed in Congress. They silently refused the petitions without telling the public as to why they are being denied visas.

A Freedom of Information Act (FOIA) lawsuit was filed by the American Immigration Lawyers Association.

Following this, the USCIS released documents in September 2019. It was shown that the agency made dramatic changes to the H-1B policy without accounting for these changes in the law.

Table 3: Quarter Wise FY 2019 Denial Rate for H-1B Petitions for Initial (New) Employment

88,324

27,707

24%

What does the future hold for H-1B petitions?

It is anticipated that a higher denial rate of initial petitions for the fourth quarter of FY 2019 is to turn up. This shows that the Trump Administration is committed to denying the foreign-born scientists and engineers to work in America. In the coming months, the procedure for hiring foreign-born individuals is to become more restrictive.

The UK is facing a crisis with its Brexit deal still pending. There are many questions and queries that remain […]

The UK is facing a crisis with its Brexit deal still pending. There are many questions and queries that remain unsolved. Will the Brexit deal take place? What happens if it doesn’t? Can the UK travelers enter the EU without a job offer after Brexit? What are the systems put in place to deal with the UK visa issues? Will there be free movement after Brexit?

The citizens of the UK are confused and this confusion only seems to be increasing. In this article, we will try and solve some of your queries. Read further to know about the situation after Brexit.

Will there be free movement after Brexit?

The United Kingdom is scheduled to leave the EU on October 31, 2019. The Queen gave a speech on 14 October 2019 which marked the State Opening of Parliament. She stated that a new UK visa and immigration bill will be introduced that will end free movement between the UK and EU, once we leave the EU.

She also said that a point-based immigration system will be put in place from 2021.

What about the European citizens?

The Queen stated that the European citizens who have built their lives in the UK and have contributed so much to its economy will have the right to remain. The government of the UK is working in this direction.

But the EU citizens will be subject to the same visa and immigration controls as the non-EU citizens from January 2021. The citizens of Ireland will be exempt from these conditions according to the new bill. There will be free movement with Ireland.

What does Australia have to do with this?

The point-based system that the UK plans to launch from 2021 is like the Australian immigration system. Apparently the Australian government has been advising the UK Home Office on how this system could operate.

How will the point-based system work?

A point-based system is a way of ranking and prioritizing applicants for work visas.

The points-based system works in Australia to attract the highly skilled workers who could add value to its economy and fill skill shortages.

Australia only wanted to invite younger applicants. One of the key categories of its immigration program is the factor of age. The country wanted applicants under the age of 50 years. Younger applicants get 30 points and those approaching the age of 50 get zero points. Being proficient in English is also a major category in the program. If you are able to read and write English to a satisfactory standard you get good points. If you have a superior grasp on English you get even more points. Under this system, your educational qualification and work experience matter a lot. Better qualified candidates are preferred.

What will the UK immigration system look like?

The Conservative party has time and again expressed its inclination towards the Australian immigration system. The Home Secretary Priti Patel has also made it clear that they plan to introduce an immigration system like Australia’s.

The UK government wants an immigration system that invites leading people in their fields to fill the skill shortages where they are needed the most. They want the system to work in the interest of Britain. They want a system that is under the control of the British government.

Why are the employers still confused?

Many employers have been left confused by this announcement. They said that the announcement was very vague. The UK already has a similar system in place under the Tier 2 category. They are in confusion about how the UK plans to go about its immigration system and what new changes will be brought about.

A clear indication is yet to be given by the authorities. This leaves the employs in a very unsafe place.

A restrictive point-based system might be put in place which requires all workers to be under the sponsorship of their employers and meet the point-based skills threshold. This system invites only a selected few to the UK. There are still doubts about whether such a system will ever be put in place due to UK politics and the general elections taking place in the coming weeks.

Immigration to Canada is a clear cut procedure. The government has added further simplifications to attract migrants. The two most important immigration programs of Canada are – Express Entry System and the Provincial Nominee Program (PNP). The Express Entry System is a government-operated system for immigrants. The PNP is a province-specific program tailored to the needs of provinces. PNPs are usually for skilled workers. Saskatchewan is a popular province of Canada with a booming economy. It has plenty of natural resources like minerals, oil, natural gas, and potash. The province provides a reasonable cost of living and plenty of jobs.

What is the Work Structure of a PNP?

If you are nominated through a PNP, you get 600 extra points under the Comprehensive Ranking System (CRS). This increases your chances of getting an ITA (Initiation to Apply).

This program is for those who:

Have the skills and education required to contribute to the economy

Want to live in a particular province

Want to become permanent residents of Canada and can adapt to the lifestyle

Each province has its own streams whereby they target certain groups like

Students

Business people

Skilled workers

Semi-skilled workers

The categories under the SINP are as follows:

International Skilled Worker Category

Entrepreneur Category

Farm Worker Category

We will be looking into the category that invites application for the skilled workers through its PNP known as the Saskatchewan Immigrant Nominee Program (SINP).

What is the Procedure for the Application?

You must meet the edibility criteria of the province to which you wish to apply

Submit an Express Entry Profile

Meet the minimum criteria of Express Entry

If you are invited to apply, submit an electronic application to Immigration Refugees and Citizenship Canada (IRCC)

There will be a SINP Expression of Interest (EOI) draw

If selected, you will receive SINP nomination and get 600 extra points under Express Entry CRS.

You will then get an ITA for permanent residency (PR) to Canada.

What are the Eligibility Criteria to Immigrate to Saskatchewan?

There is a general eligibility criterion common to all the PNPs which are as follows:

Age- 12 points

Level of Education- 23 points

Work Experience- 15 points

Language Proficiency(English and French)- 20 points

Connection to Saskatchewan and Adaptability- 30 points

There are marks awarded on the basis of these general criteria. Total marks are 100 and a minimum of 60 marks is needed to proceed further.

The criteria for Saskatchewan, in particular, are as follows:

Get a minimum language score of 4 on the Canadian Language benchmark

One year of work experience for skilled professionals

Two years of work experience for skilled trade workers

You should have completed post-secondary education, training, or apprenticeship which is equal to at least one year of the Canadian education system

You should have proof of your professional status

You should have a settlement fund and a settlement plan

You need to submit an Educational Credential Assessment (ECA) from a designated organization.

What are the in-demand Occupations for this Province?

The immigration system in Australia is much like Canada. It is based on the point-based system whereby the government allocates […]

The immigration system in Australia is much like Canada. It is based on the point-based system whereby the government allocates points and then invites you to get a permanent residency (PR) visa to stay in Australia. Australia too is in need of skilled workers and so encourages the foreign skilled workers to apply for permanent residency. Many do so willingly, allured by the high standard of living and job opportunities in the country. But what if you are married and now want your spouse to stay with you? How can you bring your spouse to Australia on a permanent visa? Let us find out the relevant spouse visa categories for Australia.

Which is the relevant spouse visa category for Australia?

Australia has many categories under which a spouse can apply for a permanent visa. The categories will depend on the location of the spouse, whether he/she stays inside or outside Australia, the relationship status of the partners, visa category of the sponsor, etc.

The most common and useful category is when a spouse of an Australian permanent citizen is staying outside Australia and wishes to apply for permanent residency. The category, in this case, is a Partner (provincial) Visa (subclass 309).

What is Partner Visa (subclass 309)?

The Partner Visa Subclass 309 is the category designed for those applicants, staying outside Australia, who wish to stay with their spouse or de facto partner who is the Australian permanent resident and so want to apply for a permanent residency visa.

What are the eligibility requirements for the Subclass 309?

You as an applicant are allowed to apply for a permanent resident visa under this category only if you are married or in a de facto relationship with a person who is:

Australian permanent resident

Australian citizen

Eligible citizen of New Zealand

At the time of application, you stay outside Australia.

Is the Partner Subclass 309 a permanent visa?

No, the partner subclass 309 is not a permanent visa. It is a temporary visa allotted to you that will allow you to stay in Australia for a limited period of time.

Once in Australia, you will have to convert this visa into a Permanent Partner Visa (Subclass 100), which will allow you to live permanently in Australia with your partner.

What is the procedure to apply for a permanent visa?

Once you have applied and are selected under the Partner (Provisional) Visa (Subclass 309), you do not again have to apply for the Permanent Partner Visa (Subclass 100).

The application for both these types of visas is the same. There is a single application for both these types of visas. You are not required to pay any extra fees either as the charge is for a single application only.

The application is processed in two stages. The first year is for the processing of the temporary subclass 309 visa and the second year if for the processing of the permanent subclass 100 visas. So you are required to wait for a year to get a permanent visa.

What are the benefits of the Partner (Provisional) Visa (Subclass 309)?

This visa even though temporary allows you to:

Travel to Australia and stay there till the Partner visa is processed.

You can pursue studies in Australia. But there will not be any government funding.

Enroll for a job opportunity.

Enroll for a healthcare scheme, i.e., Medicare in Australia.

What are the key benefits of the Permanent Partner Visa (Subclass 100)?

Once you are allotted the permanent visa you can:

Live in Australia with your spouse for an indefinite period.

Study and Work in Australia.

Make an application for Australian citizenship (if you are eligible).

You can sponsor your relatives for permanent residency (if they are eligible).

Enroll yourself for Social Security Payments.

Conclusion

So if you wish to stay with your spouse who is already an Australian permanent resident, then you can do so by following the above-mentioned steps.

It is important to note that the Permanent Partner Visa will allow you to stay in Australia for a period of 5 years without restrictions. After 5 years you are required to renew the visa (if you haven’t already got an Australian Citizenship). If you do not renew your visa, you may be asked to leave the country.

Canada is one of the top tourist destinations in the world. Being the second-largest country in the world it has […]

Canada is one of the top tourist destinations in the world. Being the second-largest country in the world it has a diverse landscape. With its glaciers, vistas, provinces, water sports, vibrant and multicultural city life, Canada is no doubt a sought after tourist destination.

But applying for a Canadian visa is no cake and your application can easily be rejected if not carefully filled. The most important question in any visa officer’s mind is that will the candidate return to his or her country of origin once the visa expires? Below are some of the secrets to a successful Canadian tourist visa which caters to this one important question.

Submit all the required documents

Most of the applicants submit just the minimum documents listed in the form. This is not sufficient proof to the IRCC that you are intending to return after your visit. For example, if you are an employee you need to submit your bank statement, certificate of employment, and ITR. If you fail to submit any of these documents you visa stands to be outrightly rejected.

Do not at any point in time submit fake documents. This will not only lead to rejection but you can also be blacklisted as submitting fake documents is a crime.

Show sufficient evidence to your deep-rootedness

Here you need to show sufficient evidence of a connection to your home country. The officer needs to be sure that you will not illegally work in Canada and deplete their resources.

Copies of title deeds, lease agreements, employment contracts, employment letters, letters confirming your involvement in local community activities, etc can be added as proof of your strong ties and your establishment in your home country.

Collect passport stamps

One of the requirements of the Canadian immigration authorities for a Canadian tourist visa is a copy of your visas (valid or expired) as well as your entry and exit stamps. As a tourist, you must make a habit of collecting these if you want your want visa to be approved.

Have the right amount of show money

The authorities are not concerned with how much money you have in your bank account so you can forget about the fund transfer schemes. They look into your average daily balance and a steady source of income. You need to have sufficient funds to sponsor your trip to Canada.

If you do not have sufficient funds then you can submit a letter of the affidavit. It is a document attesting that the signatory will meet your flight, hotel, and day-to-day expenses. Along with this you also need to submit the sponsor’s financial documents like Bank statement, ITR, and proof of income. The sponsor could be your parents, relative, friend, or employer.

Get a letter of invitation if possible

A letter of invitation is a document where the signatory who is currently staying in Canada attests that he/she will provide you with food and accommodation during your stay in the country. The letter should include your name, birth dates, and travel dates. It should be signed by the person writing the letter.

This letter also serves as great proof that you intend to return to your home country.

Make the purpose of visit clear

You need to provide a clear reason for your trip to Canada and the length of your visit should match with the purpose of your trip. The purpose could be tourism, visiting a friend, visiting family, temporary business visit, etc. But it needs to clear and should not raise suspicions. Do not provide any false information.

Show the specific status in your home country

You need to provide a specific legal status of your home country. You may have dual citizenship, permanent residence, temporary status, whatever it is mention it clearly on your application. Your supporting travel and immigration documents need to be current when you apply for a Canadian tourist visa.

Provide your civil history

You should not pose any security or health risks to the immigrant country. For this, you can provide health and travel insurance as an indicator of your well-being. You also need to have sufficient funds to return to your home country. Bank statement acts as a proof of this.

You can show your extensive travel record to ensure that you have successfully entered and exited many countries and intend to do the same here.

Canada is rapidly becoming the country to wholeheartedly welcome immigrants. The reasons for the rising numbers is plain and simple- Canada’s population is aging rapidly, its birth rate is declining and so labor shortages are increasing as a result.

This is especially the case for smaller provinces that are facing permanent loss in residence as their citizens are shifting to other parts of Canada. To tackle these provinces are taking advantage of the earlier dormant PNP programs as the federal government used to solely dominate the immigration policy.

What is the PNP program?

Canada’s Provincial Nominee Programs (PNP) was enacted by Canada’s Constitution Act 1867. According to this Act, each province of Canada has the ability to make laws on immigration for their respective provinces.

The PNP gives nine Canadian provinces and two territories the power to select some immigrants who meet their local labor market needs.

Quebec is the only Canadian province that does not take part in PNP as it has a separate agreement with the federal government that gives it the sole responsibility to select all its economic-class immigrants.

How does the PNP work?

The basic idea of the PNP is to allow each province to use a certain number of allotted spots and develop programs customized to the individual province’s needs and aspirations.

Thus the provinces identify a specific skill or profession of which it is in need and encourage investment in that particular area. It then retains persons meeting their priorities.

What do the numbers say?

The number of immigrants entering through the PNP is significantly on the rise. The 2019 target is for 61,000 permanent residents to enter Canada through PNPs whereas 55,000 immigrants did so in 2018.

Ontario’s program is the largest with 6,900 permanent residents allocated.

Manitoba was the first province to use PNP in 1998. Since then 1,30,000 economic immigrants have entered the province and almost 90% have stayed.

Is an invitation needed under PNP?

Canada’s most popular PNP pathways use invitations to apply as a first step in the nomination process. This means you need to be invited to apply for a provincial nomination.

Once the invitation is received, a complete application needs to be sent within a given time frame for the immigrant to be considered eligible.

Conclusion

Canada’s provincial nominee programs are very dynamic and constantly enhance their priorities. Targeting early childhood educators, people with work experience, registered nurses have been the trend.

The opportunities to immigrate under PNP are considerable and so an applicant aiming for Canada should look into it.
